Terms and Conditions

Use of the Site and related products and services is contingent upon your acceptance of and compliance with these Terms and Conditions (“Terms of Service” or “Agreement”) and our Privacy Policy on the Site (“Privacy Policy’), which together constitute a legal agreement (the “Agreement”) between you and ZANE’S.

Acceptance of Terms | Account Establishment

Use of ZANE’S’s site constitutes account user’s acceptance of all terms and conditions and agrees to be bound by this Agreement. To create an account user must be 18 years of age; Account User will establish a “Login”, which will include an Email Address and Password. Account User is solely responsible for maintaining the confidentiality of the “Login” and for all use of “Login” whether authorized or not. In consideration of your use of the Site and Service, you agree to: provide true, accurate, current and complete information about yourself in responding to and completing the account user form; and to keep the account user information true, accurate, current and complete by maintaining and updating when necessary. Account User represents that you are at least 18 years old and that you are the legal guardian of the child/children for whom the meals, snacks, or other food items described on the Site (collectively, “Food”) or other aspects of the Service are ordered. As the legal guardian, it is your sole and exclusive responsibility to determine whether the Food or any other aspects of the Services and/or the Site and its content is appropriate for any such child/children or other children for whom you are the legal guardian. Your access to and use of the site, its content, and our services are expressly conditioned on your compliance with these Terms of Service.

Ordering & Cancellation.

ZANE’S strives to suit the individual needs of your child; however, you acknowledge and agree that the meals cannot be modified to suit all the individual needs of your child. Account User is responsible to contact ZANE’S to resolve errors in ordering. ZANE’S is not responsible for unconfirmed, inaccurately submitted, or unintentional orders placed by account user. To ensure that each meal is prepared fresh and to guarantee that enough food is purchased and prepared, ZANE’S requires orders to be placed at least one week before the concerned date on the website. Ordering farther in advance is encouraged. Meals CANNOT be canceled for refunds but your order will be credited to your account if you cancel promptly before 7:30 am IN AN EMAIL. Any changes to existing orders must be received by the 8 pm, day before deadline. Rescheduled credited days would need to comply with our ordering policy.

Modification | Termination

If you violate any of these Terms of Service, your permission to use the site and the services will automatically terminate. ZANE’S reserves the right to revoke your access to and use of the site and to terminate your account at any time, with or without cause, and with or without notice. ZANE’S hereby reserves the right to change these Terms of Service in its sole discretion. ZANE’S reserves the right to change the site, to modify the services, to change its lunch offerings, to change pricing, to change other components of its services at any time upon notice by posting those changes to the site. Notice of any such changes will be posted on the Site and continued use of the Site thereafter shall be deemed an acceptance and ratification of any such changes by the applicable user.

Site Use

WE PROVIDE OUR SITE ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO THE OPERATION OF OUR SITE OR THE INFORMATION, CONTENT, SOFTWARE OR MATERIALS AVAILABLE ON OUR SITE (INCLUDING, WITHOUT LIMITATION, WARRANTIES OF FITNESS, MERCHANTABILITY, NONINFRINGEMENT, OR ANY IMPLIED WARRANTIES ARISING OUT OF COURSE OF PERFORMANCE, DEALING OR TRADE USAGE). IN ADDITION, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTION OR ERRORS. FURTHER, WE TAKE NO RESPONSIBILITY FOR THE CONTENT OF ANY LINKS PROVIDED THROUGH OUR SITE OR FOR THE SITES OF OTHERS THAT LINK TO OUR SITE.

Allergies

It is Account User’s responsibility to identify and communicate any and all food-related allergies of their Participant(s) to ZANE’S by providing the appropriate information in the Participant’s account. ZANE’S meals are prepared in a facility that uses soy, wheat, dairy and other known allergens. While we strive to serve mostly organic/NON gmo food, ZANE’S does purchase food from outside vendors that produce ingredients or products manufactured on shared equipment. These vendors are also aware of allergy issues; however, there can be no assurance that any food is absolutely allergen free. Individuals with known or unknown food allergies and/or specific health conditions, order from this menu at their own risk and at their sole discretion.

ZANE’S DOES NOT MAKE, AND EXPRESSLY DISCLAIMS, ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, IN REGARD TO ANY INFORMATION, PRODUCT, OR SERVICE FURNISHED BY IT UNDER THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ZANE’S DOES NOT GUARANTEE THAT THE MATERIALS, INFORMATION OR SERVICES PROVIDED THROUGH THIS SITE WILL BE ERROR-FREE, OR CONTINUOUSLY AVAILABLE, OR FREE OF VIRUSES OR OTHER HARMFUL MATERIALS. Severability

In the event that any provision of these Terms of Service is held to be invalid or unenforceable, the remaining provisions of these Terms of Service will remain in full force and effect.

Waiver

The failure of ZANE’S to enforce any right or provision of these Terms of Service will not be deemed a waiver of such right or provision.

Controlling Law and Jurisdiction

These Terms of Service and any action related thereto will be governed by the laws of the State of California without regard to its conflict of law provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms of Service will be the state and federal courts located in Los Angeles County, California, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.

Entire Agreement

These Terms of Service are the entire and exclusive agreement between ZANE’S and you regarding the site, use of our services and your family’s participation in the ZANE’S program at your school. These Terms of Service supersede and replace any prior agreements between ZANE’S and you regarding the use of our site or services or participation in the program
